Terms of Service for Job Seekers.

Job Adverts or Job Listings.

CV and Job Recommendations.

By creating a public CV through the Site, you request and authorize Qivme to provide your CV to third parties, such as Companies, who according to Qivme may be interested in your CV. By creating or uploading a CV on Qivme (“CV Qivme”), we can share with you a Job List that matches the content of your Qivme CV. Qivme is not responsible and releases all responsibility for CV or application information that you post, send, or receive through the Site. If you notice inaccuracies in the material, it is your responsibility to correct the information or contact Qivme to correct it. To protect your privacy, Qivme can cover or hide your contact information, such as email address, from your CV and can replace it with an alias.

All CV or application information that you submit to the Site, including Personal Data included in CVs, applications, or answers to screening and due diligence questions (“Apply from Qivme”), is subject to this Agreement (including section D.3.) When you apply for a job using Apply from Qivme, Qivme will endeavor to send your application to the contact information provided to us by the Company or its Agent. We do not guarantee that messages and applications will be sent, received, accessed, read, or acted upon. Qivme also does not guarantee that the Company will receive, notify, access, read, or respond to CVs or other application materials, or that there will be no errors in data transmission or storage. However, Qivme can let you know when such an event occurs. Please note that Job Ads may expire between the time the ad is received and the time you submit your application. Qivme is not responsible for expired Job Ads or for submitting applications before the Job Ad has expired. Other than that, we cannot guarantee the validity of the contact information provided to us by the Company. We also cannot guarantee the technical capabilities of third party sites, including, but not limited to, Applicant Tracking Systems (ATS) or Applicant Tracking Systems. If you feel uncomfortable sending your application or message in this way, or that your application or message is stored on Qivme, do not use Qivme’s Apply function or Qivme’s messaging system, and please send your application or message directly to the Company via other methods that are available. When you search for vacancies on the Qivme Job Search app and continue to apply for vacancies, including vacancies on third party sites, Qivme can suggest information from your Qivme profile to be included in your application. It is your responsibility to review these suggestions before accepting them and including them in your application.

For job seekers located in Indonesia, you acknowledge that when contacted by Qivme, which is displayed as Qivme Hire (hereinafter referred to as “Qivme Hire”), Qivme acts as an Employment Agent (as defined in applicable law). The services offered by Qivme Hire are governed by these terms. Qivme Hire will only send you a List of Vacancies that Qivme Hire thinks you might be interested in. You further acknowledge that Qivme Hire is not authorized to accept money on your behalf and / or enter into contracts on your behalf. You can also end your relationship with Qivme Hire at any time.

Communications and Other Actions on the Site.

Qivme Eligibility Test.

The Qivme Eligibility Test is an online tool for providing and reviewing employer-selected skills eligibility tests (“Eligibility Tests”) and jobseekers’ responses (“Responses”) via the Site. Employers can use the Qivme Due Diligence tool to send you a Due Diligence, which you can use to provide Feedback. Once you have provided a Feedback, Employers will be able to use the Qivme Due Diligence platform to check the Responses. If there are multiple versions of the same Eligibility Test, the Response percentile for Job Seekers will be determined simply by relating them to other Responses for the same version of the Eligibility Test.

The Eligibility Test only evaluates certain skills. The test does not evaluate Job Seekers’ qualifications for any vacancies. The employer that sends the Eligibility Test and reviews your Responses will fully decide whether a particular skill is relevant to the vacancy, or whether the Job Seeker is qualified or suitable for a vacancy. Accepting or responding to the Eligibility Test does not guarantee a job or job offer, or a salary offer of employment, or any further communication or action by the Company. The Company is the only party that determines whether a Response indicates that the Job Seeker is eligible or not. The company may instruct Qivme to send you a refusal notification if you have not responded to the Due Diligence in a manner acceptable to the Company, and you acknowledge that Qivme has no discretion in sending such rejections. The company is the only party that determines whether to consider a eligibility test that is followed back as part of their recruitment process.

You acknowledge and understand that the Company chooses which Eligibility Tests will be associated with their vacancies, and that Qivme does not select the Eligibility Tests sent by the Company and has no control over the selection or use of the Due Diligence by the Company. You agree that the questions in the Due Diligence Test are entirely submitted by the Company that sent the Due Diligence and are not asked by Qivme. You further agree that Qivme is not responsible for offering alternative screening methods, if required by Indonesian law, and that the responsibility for offering such alternative methods rests entirely with the Company. If you require accommodation, or (some) Eligibility Test methods, screening or alternative applications, you must submit this to the Company. Qivme can provide a means that you can use to request alternative methods or other accommodations from the Company; Qivme does not guarantee that the Company will accept or respond to such requests. Qivme does not guarantee that the method of submitting the Due Diligence questions will comply with Indonesian Law or other equivalent state laws.

You agree and acknowledge that the usefulness and value of the Due Diligence and Response Tests depend on maintaining the confidentiality of the due diligence content and responses. Therefore, you agree to maintain the confidentiality of the contents of the Due Diligence and Responses, and not reproduce or discuss them with anyone, except that you can communicate with the Company about the Due Diligence they have sent you and your Responses.

As a Job Seeker, you agree that your Responses, applications and other communications sent through the Qivme Eligibility Test will be processed and analyzed by Qivme based on this Agreement and the Qivme Privacy Policy. You request and allow Qivme to provide your Feedback to the Companies that administer the Due Diligence Test, or (if a Due Diligence is selected by you) to any Company that views your Qivme Profile. You understand that there is no guarantee of this, and that Qivme reserves the right to display or reformat the Responses in such a way that the Company can check your Responses together with Responses from other Job Seekers. Qivme can combine the results of all the Eligibility Tests that Job Seekers select for the purpose of displaying your Response percentile. You also acknowledge that once you have asked Qivme to send your Responses to the Company, the request cannot be canceled. Qivme does not guarantee that the Company will receive, access, read or respond to Responses, or that there will be no errors in data transmission. However, Qivme can let you know when such an event occurs.

As a Job Seeker, you may not create or send any Responses that: (i) contain highly confidential personal information, such as bank or credit card account information, online account information, social security numbers (or similar identification numbers outside of Indonesia), health information. , or any other category of data which is subject to the specific infringement notification requirements in any country; (ii) contains proprietary information, trade secrets, confidential information, advertisements, solicitations, chain letters, pyramid schemes, investment opportunities, or other unsolicited commercial communications (unless expressly permitted by us in writing); or (iii) directly or indirectly violates the Site Rules.

Qivme is not a third party beneficiary or is not responsible for any agreement between the Company and Job Seekers, regardless of whether Qivme receives fees from the Company in connection with the transaction. Qivme will not be responsible for any costs or losses arising out of or related to the transaction.

Qivme is not responsible for, and disclaims all liability, for the content, accuracy, validity, completeness, legality, reliability or availability of the Site, the Qivme Due Diligence tool, and any Due Diligence or Feedback.

Salary, Career, Recruitment and Other Information Provided by Qivme.

Your Job Seeker Data.

You also agree that, as a service for Job Seekers, Qivme can enable Qivme’s Application submission function to be used in conjunction with your Job List, and that Job Seekers who wish to show interest in the Job List can only do so via Qivme’s Apply, and that Qivme will send applications to the email address you provide to us. You also agree that Qivme can activate chat bots, which allow Job Seekers to apply for your Job Ads by answering questions. Answers submitted by Job Seekers will be presented to you as a job application. When you use Qivme’s candidate management tools, including but not limited to the Company Dashboard, or by enabling Qivme’s Application submission function for your Job List, means that you acknowledge and agree that Qivme can provide several functions that allow you to take action regarding Job Seekers, such as tools to organize interviews, view CVs and reject candidates. You agree that by using these candidate management tools, you provide instructions to Qivme to compile candidate application materials, CVs, answers to screening questions, eligibility test responses, and other information that you provide to Qivme into one document. You also agree that Qivme is not responsible for the maintenance or storage of such application materials, and that you are responsible for your own compliance with all applicable records retention requirements. By using these tools, You provide information to Qivme and request and authorize us to provide that information to suitable Job Seekers. In addition, you agree that all information shared through Qivme will be processed and analyzed by Qivme in accordance with this Agreement and Qivme Privacy Policy. Qivme can save this information even if the job vacancies are filled.

When you use Qivme’s Application submission function for your Job List, you acknowledge and agree that Qivme may add functionality to the appropriate Qivme Apply email. In addition, Qivme can, on your behalf, send reminder emails to the Job Seekers you wish to interview. Qivme can also send an email to Job Seekers on your behalf stating that your Job List may match the Job Seeker’s CV. When you use screening questions, you will be given the option to instruct Qivme to send a rejection notification if a Job Seeker does not answer the question in the manner specified in the online instructions. If you choose that option, You agree that you instruct us to send the candidate a rejection notification and set the status as rejected on your candidate dashboard. You also acknowledge that Qivme has no discretion in sending or storing these rejection notices or any other rejection notices (which are fully automated), that this delivery or storage is not guaranteed, and that Job Seekers may not accurately answer screening questions. When you use Qivme’s candidate management tool, you will be given the option to send automatic rejection notifications to candidates whose status you have set to “rejected”. If you choose this option, you acknowledge that Qivme has no discretion in sending or storing rejection notifications.

You agree that Qivme can take action to try to identify and reduce spam applications, and one method of doing this could include mandating application letter requirements for such applicants. Qivme does not verify the identity of any Job Seekers who apply to your job listings, and Qivme does not know the motivation of Job Seekers to apply to your job listings, so Qivme makes no guarantees regarding the qualifications or interests of Job Seekers in your job listings. You agree that the Apply from Qivme and the Qivme messaging function provided to you is without warranty, and Qivme is not responsible for the communication made between you and the Job Seekers, and such communication is entirely the responsibility of you and the Job Seekers.

Governing Law and Dispute Resolution.

This Agreement and any Disputes arising out of or in connection with this Agreement or related in any way to the Site will be governed by all matters, including but not limited to the validity, formation and enforcement of this Agreement, by and under the laws of the Unitary State.
